Privacy Notice (Updated: November 17, 2025)

By creating an account, purchasing credits, or using Jailhouse Mail, LLC's websites or applications to create and send correspondence to a person in custody (the "Services"), you agree to these Terms & Conditions ("Terms"). If you do not agree, do not use the Services. We may update these Terms by posting a revised version, and changes apply on a going forward basis from the updated date.

You must be at least 18 years old and have legal capacity to enter a contract to use the Services. We do not permit accounts for, or use of the Services by, individuals under 18. An adult account holder may submit correspondence on behalf of a minor without creating an account for the minor. By submitting such content, you represent and warrant that you are the minor's parent or legal guardian, or that you otherwise have authority to act on the minor's behalf, and you consent to our processing, review, and disclosure of that content in accordance with these Terms and our Privacy Policy. Do not include a minor's sensitive personal information beyond what is reasonably necessary for the message. We may refuse, redact, or delete content to protect minors or to comply with facility policy or law.

You are responsible for the accuracy of the information you provide, for maintaining the confidentiality of your credentials, and for all activity under your account. You agree to cooperate with our fraud prevention and identity verification requests where reasonably necessary.

Jailhouse Mail provides a processing and forwarding service that routes your correspondence to the correctional facility you select. Facilities make the final decision whether to accept, delay, reject, or otherwise handle correspondence. We do not guarantee delivery, timing, or acceptance. We may format, reproduce, print, transmit, and otherwise process your content as reasonably necessary to provide the Services.

You should not expect privacy in message content. For safety, security, and compliance with facility rules and applicable law, we monitor, scan, record, and disclose communications and related account activity. Review may be automated or human. Information may be provided to the applicable correctional agency and to law enforcement authorities as permitted or required by law. Our Privacy Policy explains how we collect, use, disclose, and retain information.

When physical mail is processed through the Services, we generate digital images, metadata, processing records, classifications, and other system outputs ("Derivative Data"). Jailhouse Mail retains all rights, title, and interest in Derivative Data and in any models, analytics, features, or technologies developed from it. This does not transfer ownership of the content of the original physical mail, which remains with the sender and the receiving correctional facility.

You must comply with all applicable laws and all rules and policies of the recipient facility. You will not submit content that is unlawful; threatens harm; facilitates contraband; contains coded messages; solicits, incites, or promotes criminal activity; includes sexually explicit content where prohibited; harasses, doxes, or defames others; infringes intellectual property rights; or otherwise violates facility policy. We may refuse, remove, preserve, or disclose content and related information to a facility or law enforcement at our discretion to address safety, security, or legal concerns.

Prices, taxes, and fees are shown at checkout and may change prospectively. Payments are processed by our payment providers; we do not store full card numbers. All fees are earned upon processing and are non refundable, including when a facility delays, modifies, or rejects correspondence; when delivery timing changes; or when you submit content that violates facility policy or law. Facility decisions are outside our control and are not grounds for refunds or charge reversals. To the extent required by law, we will refund charges only in these limited situations: duplicate transactions, a confirmed processing error on our side before printing or transmission, or an unauthorized card transaction determined to be fraudulent after investigation. Refunds, when granted, are returned to the original payment method. To request a review, email support@jailhousemail.com within seven days of the charge and include your name, order ID, charge date and amount, last four digits of the payment card, and a short description. We may request additional details to verify the request and typically complete reviews within ten business days. You authorize us to dispute chargebacks and to share transaction information with payment providers and law enforcement to investigate fraud or abuse. We may suspend or terminate the Services for unpaid balances, excessive disputes, or suspected abuse.

Solely to operate the Services, you grant Jailhouse Mail a non exclusive, worldwide, royalty free license to host, store, reproduce, format, print, transmit, and otherwise process your content, including to create derivative outputs necessary for facility delivery. You represent and warrant that you have the rights to submit the content and that it complies with these Terms and facility rules.

We may change or discontinue features at any time. The Services may be unavailable from time to time due to maintenance, outages, facility blackouts, or events beyond our control. We are not liable for delays or failures caused by facilities, carriers, or third party providers.

We may preserve information and cooperate with facilities and law enforcement authorities, including responding to subpoenas, warrants, court orders, or other legal process. We may suspend or terminate your account while we review suspected violations.

The Services, site, software, and related intellectual property are owned by Jailhouse Mail or its licensors. We grant you a limited, personal, revocable, non transferable license to use the Services for their intended purpose. You may not copy, modify, reverse engineer, or exploit the Services except as permitted by law.

Do not attempt to circumvent facility rules or our safeguards. Do not interfere with security features, probe or scan our systems, or use automated means that burden the Services. We may rate limit, block, or disable access to protect the Services or to comply with law.

THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE." TO THE MAXIMUM EXTENT PERMITTED BY LAW, WE DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON INFRINGEMENT. WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, TIMELY, SECURE, OR ERROR FREE, OR THAT FACILITIES WILL ACCEPT ANY PARTICULAR CORRESPONDENCE. TO THE MAXIMUM EXTENT PERMITTED BY LAW, JAILHOUSE MAIL AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AND AGENTS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, OR GOODWILL, ARISING OUT OF OR RELATED TO THE SERVICES OR THESE TERMS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIMS RELATED TO THE SERVICES WILL NOT EXCEED THE AMOUNTS YOU PAID TO JAILHOUSE MAIL FOR THE SERVICES IN THE TWELVE MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM.

You will defend, indemnify, and hold harmless Jailhouse Mail and its officers, directors, employees, and agents from and against any claims, damages, losses, liabilities, costs, and expenses arising out of or related to your content, your use of the Services, your violation of these Terms or facility rules, or your violation of law.

You may stop using the Services at any time. We may suspend or terminate your account or access at any time with or without notice if we believe it is reasonably necessary to protect safety or security, to comply with law, to address fraud or abuse, or if you materially breach these Terms. Provisions that by their nature should survive termination survive termination, including payment obligations, licenses granted by you, investigations and preservation, intellectual property, disclaimers, limitations of liability, indemnification, governing law and venue, and miscellaneous terms.

These Terms are governed by the laws of the State of Utah without regard to conflict of laws rules. You agree to the exclusive jurisdiction and venue of the state courts located in Utah County, Utah and the federal courts located in the District of Utah, and you waive any objection to jurisdiction and venue in those courts. For correctional agencies that have separate written contracts with Jailhouse Mail, those contracts govern in the event of a conflict.

We are not liable for delays or failures caused by events beyond our reasonable control, including acts of God, natural disasters, labor disputes, government actions, facility lockdowns, network failures, or interruptions by carriers or third party providers.

Our Privacy Policy explains how we collect, use, disclose, and retain information. For most records handled on behalf of a correctional agency, that agency is the controller of those records and we act as its service provider or processor.

We may provide notices by email, in app messages, postings on our website, or by mail. Legal notices to Jailhouse Mail should be sent to support@jailhousemail.com.

These Terms, together with any policies referenced in them, are the entire agreement between you and Jailhouse Mail regarding the Services. These Terms do not create any third party beneficiary rights. If any part is found unenforceable, the remainder remains in effect. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or corporate reorganization. No waiver is effective unless in writing. Headings, if used, are for convenience only and do not affect interpretation.

Changes to These Terms and Conditions

We may periodically update these Terms and Conditions. You are advised to review this page regularly for any changes. We will notify you of updates by posting the new Terms and Conditions on this page.
